Lawmaker settles in lawsuit involving wreck

WINSTON-SALEM — The former North Carolina legislator who was injured in a traffic accident that killed another driver three years ago has settled a lawsuit stemming from the incident.

The Winston-Salem Journal reports that attorneys for former state Rep. Larry Womble have filed a notice of voluntary dismissal with prejudice on a lawsuit filed in 2013. That means Womble cannot refile the complaint.

Attorney Dudley Witt said the terms of the settlement are confidential. Representatives for Carmichael declined comment.

Womble filed the lawsuit against Sixth & Vine bar and restaurant and the estate of David Allen Carmichael, the man who was killed in the crash.

Carmichael died when his convertible collided with Womble’s sedan. A police investigation revealed Carmichael had a blood alcohol level of 0.29 when he was killed.
