Judge dismisses annexation challenge

NASHVILLE — An N.C. Superior Court Judge dismissed the Oak Level annexation challenge Tuesday, affirming Rocky Mount’s plan to expand its boarders to include the eastern Nash County community.

The ruling, however, likely does not bring the legal fight to an end. Dozens of forced annexation opponents met immediately following the court hearing and mapped plans to appeal the ruling.

“I’m a little disappointed with the ruling,” said Bob Hornick, the Chapel Hill attorney representing the Oak Level Community Against Forced Annexation. “The battle isn’t over yet, though. That’s why they have the Court of Appeals.”

Rocky Mount officials said they hoped the ruling by N.C. Superior Court Judge Richard L. Doughton would end the legal wrangling over the annexation, originally scheduled to go into effect at the start of 2010.

The remanded annexation ordinance passed in December by Rocky Mount City Council is slated to take effect July 1, but a protracted appeal process, even if the courts rule in the city’s favor, would further delay the annexation.

“We’re obviously at a point where we would like to move ahead with things,” Mayor David Combs said of the annexation. “But they have made a commitment to fighting this, and that certainly is their right.”

At the core of the Oak Level community’s legal challenge is a question of whether or not the character of the 1,800 acres to be annexed is urban enough to meet state mandates for involuntary annexation.

Essentially, state law dictates that 60 percent of all noncommercial land to be annexed must be subdivided into lots of three acres or less.

Through their interpretation of several technical clauses in the state annexation laws, challenges to how the city classified huge swaths of land to be annexed and questions over how Rocky Mount officials implemented a so-called “necessary land bridge” in the remanded ordinance, the Oak Level group has argued that their community is more rural than it is urban, and therefore ineligible for annexation.

Hornick said he would raise the same basic arguments during an appeal.

Charlene Moore, a leader among the Oak Level protest group, said she and her neighbors were not deterred by the court ruling.

“We’re going to take this case as far as we can,” Moore said after the hearing. “In fact, we are excited the judge ruled the way he did. This by no means brings this fight to an end; It just keeps it going.”

Moore said city officials will be wasting local tax dollars if they continue with the annexation plans.

The city so far has spent about $1 million to extend a sewer outfall line for the Oak Level annexation and another $30,000 as of December in legal fees fighting the residents in court, Assistant City Manager Peter Varney said.

“Other than that, the impact on the budget at this stage has been, well, that there hasn’t been any impact,” Varney said.

The $1 million sewer extension came from the city’s sewer fund, Varney said, and was not tied to anticipated revenue from the annexation. The city put all other planned spending associated with the annexation on hold, he said.

The Oak Level group has 30 days to file an appeal. After that, Varney said, “We plan to arrange for the provision of municipal services to the Oak Level community” in anticipation of the July 1 annexation date.

The residents who make up the Oak Level Community Against Forced Annexation have been fighting Rocky Mount’s planned annexation for more than a year, first at City Hall and more recently in the courts and in the N.C. General Assembly.

Moore said Tuesday the group would continue funding its legal battle against Rocky Mount while, at the same time, keeping one eye on Raleigh. Forced annexation opponents hope lawmakers will overhaul state annexation laws during the short session.

“We’re not going anywhere,” Moore said.

Keep going Oak Level. I agree with a lot of posters on here. Rocky Mount has gone downhill. I hate to shop here anymore. A lot of the stores are dirty looking and just drive through downtown and see how run down it is. Main Street is horrible. Looks like my area is going to be next in line for annexation. It is time to vote these people out and get new blood on city council and other governments.

Who switched the headline?

Alright, who's the wise guy that switched the headlines of this article. The headline here says, "Judge dismisses annexation challenge", but when I got my newspaper this morning it says, "Judge OKs city's plans to annex", and it's the same exact article. Did you do this Mike? The headlines give the false impression of what exactly happened. The judge didn't okay the annexation, that smacks of "legislating from the bench", he dismissed Oak Level's challenge to the annexation. This lessens the credibility of this news paper. Truth and facts are what I thought I was paying for when I purchased my subscription, not sensationalized headlines to grab attention on false impressions.

I think each individual

I think each individual household should file seperate lawsuits, when one is dismissed, have another household file, they can't annex while there are court cases pending. Make it as painful as possible for them

Gov't Force

It breaks down into one simple thing. The gov't of Rocky Mount wants to annex the Oak Level community because they want the money. The people in Oak Level wanted to live there because it's not inside the city limits. So, the gov't is going to force itself on the people once again. To the gov't of Rocky Mount. You've destroyed your city. You have allowed the criminals and drug dealers and the people that are too lazy to work to take over your city so you lose money. Instead of trying to force yourself on the good people of Oak Level to make money, how about actually cleaning up your filthy town and attracting the decent, working class to your town? You've done nothing but run everyone out of that town. Decent people can't even go to the mall and shop because of the gang members. It might be time for the citizens to force the gov't to listen to us. It might be time for the citizens to make the gov't understand that we, the people, control the gov't, the gov't does not control us. Maybe it's time for the gov't to actually do their job and stop the crime and gangs that are in control of Rocky Mount.

Everyone remember this

The city brought the fight to us. We did nothing to cause this. But, since they attacked we will retaliate with every once of fight we have. We will deal with the current problem, our specific battle, in the court system. We will deal with the long term problem of NC Forced Annexations by changing the legislation that allows this horrendous activity by greedy city councils. Battle is ongoing on 2 fronts. But, stay tuned because RMT is NOT getting us by their publicized date of June 2010. We aren't rolling over - join us and protect your freedom from some other little known oppressive law the council will pull out on you sometime in the future.

Cape Fear Business News

The Cape Fear Business News has an interesting article about forced annexation and Rocky Mount officials incorrect claims about racist motivations behind the dispute. In Fact the publication mentions that the fight against forced annexation is nothing new for North Carolina.

Taxes

While the annexation appeal continues that means no taxes from Oak Level to pay Rocky Mount and the city council will be raising taxes for the city citizens to pay to make up for that. What a shame.

our taxes are high enough. Rocky Mount has the highest utility rate in the state as well. Who is going to pay for the $30,000 already spent by the city for this project? They need to put everything on hold until this fight is over. My area was annexed as well. I do not like living in the city limits. When my homes sells, I will move far enough out so I can not be annexed again.

Annexation

I concede that if I were to gain from being annexed, I would gladly pay my share. However, there is nothing I really would gain from being annexed now. The chickens and I along with all the wildlife wouldn't notice any difference. I have a well and septic tank. I do my grocery shopping in Nashville. My police and fire protection is just dandy with the county agencies. I have no problem with taking my trash to the county land fill/convenience center. Best of all, my combined heating/cooling and electric bill for my house (1000 sq ft) per year is averaging not more than $135.00 a month. So, to be annexed will mean that I will vote against any politician that I can that supports annexation. Rocky Mount is sorely in need of competent leadership.........thats a fact.

I notice my comments were removed. Not sure why, but I'm guessing those comments that show my reasons why I am not in need to be annexed and my voting preference if it does happens, is too much to put here. Not one statement was out of line. I now believe the telegram blog is definitely one sided leaning toward protecting the political landscape in Rocky Mount. What a real shame. I am going to try again.....just to see if my hunch is right.

Here's my spin...

(I posted this on the city desk section and thought I would move it here also) While the Judge did rule in favor of Rocky Mount today, it really didn't matter who he ruled in favor of. It was made clear yesterday when the Judge asked both parties if he ruled against them, would they appeal this case, and both parties agreed they would appeal. So, this only moves the process to the next inevitable step. In order to win, all the steps have to be taken and OLCAFA is just one step closer to victory. After the hearing, the group met with Mr. Hornick, everyone had smiles on their faces and were satisfied with the outcome. To look at everyone there you would have thought they won, but they all know the process isn't over and will be a hard row to hoe. This only energized them even more. There was never a word spoken of giving up and I know these people will fight this to the end. I'm proud of these folks, because if it weren't for people like this, we wouldn't have the freedoms we all enjoy today. If you agree that forced annexation is wrong, then support these folks when they have fund raisers and/or by giving donations to help with this fight. They are not only fighting for their right to choose, but they are also on the front lines in the fight for YOUR right to choose.

I asked someone who lived on Country Lane off Oak Level Rd by I-95 why they didn't ask Nashville to annex them. My thinking is Nashville is better than Rocky Mount and you are going to be annexed, come hook or crook. The answer I got was they did not want to be in any city limits.

I agree that the annexation of the Oak Level is stupid. You moved there to be outside of city taxes. The only area I believe is suitable to be annexed is Shell Castle because of the proximity to Westry. I support your fight. But sadly you're going to lose. Bunn Farm lost. If you win one battle, the city will just alter the plan just enough to win. Keep fighting until the last breath.

But whatever you do, don't boycott anything in Rocky Mount. What would happen if the boycott was successful? Businesses would close. That means less tax dollars. Which means higher taxes to make up for the shortfall. Which means a shrinking city. Which means higher crime and lower property values. Cities are either growing or dying. A dying city affects everyone nearby. The worst thing to be a part of is a dying city.

A Dying City

A city dies because of poor leadership. Rocky Mount is dying because the leaders of Rocky Mount refuse to take steps to fix the problems. Gangs, drugs, murders, and fights are all that Rocky Mount has to offer now. THIS is why Rocky Mount is dying. Because the gov't of Rocky Mount refuses to actually fight the real problem. So, the people have started going elsewhere to do their shopping. People in the communities east of Rocky Mount are going to Greenville now. People in the communities west of Rocky Mount are going to Knightdale. No one wants to go into the sewer town that Rocky Mount has become. My family and friends have all stopped going to Rocky Mount. Better to drive an extra 15 or 20 minutes and go to a decent, clean, and safe community than to go into Rocky Mount and deal with the street-scum gang members.

If I'm not mistaken...

Nashville was considered as an option, but because of a deal made years ago, with a little arm twisting by the city, Nashville said they wouldn't consider it because Oak Level fell on the wrong side of a line drawn on a map.

WE FIGHT ON

As Winston Churchill said during the early stages of WWII; "we shall fight on the beaches, we shall fight on the landing grounds, we shall fight in the fields and in the streets, we shall fight in the hills; we shall never surrender". We (OLCAFA) intend to continue the fight. We are in the right and the City is in the wrong, plain and simple. We will not stand by and see our hard-earned money go to the City of Rocky Mount so they can waste it on yet another boondoggle, rather than to spend it on cleaning up the huge mess they have created. We will not stand by and be taxed by a government that we are not represented by. We will not stand by to see our homes and property taken over by a City that we do not wish to be part of. We will not stand by to be forceably taken over by a government that has shown itself to be totally unresponsive to the needs and wishes of its current citizens. In closing, I would like to to paraphase FDR; With confidence in our cause, with the unbounding determination of our people, we will gain the inevitable triumph -- so help us God.

Anyone here ever actually studied Churchill? He was to London during WWII what BUSH was to the 9/11 & Iraq. Popular only for that small event in time and despised and voted out quickly afterward. Churchill was great when the enemy was someone to rally behind. He sucked when trying to work things out amongst his own people in his own country.

Kinda like the OLC folks' egos vs. the City of RM egos. Blustery words with not ONE shred of opportunity provided by either side to peacefully coexist and move forward.

Stand by and spend your hard earned money fighting this... for it to happen any way. The City will keep spending tax dollars to fight it - because now it has to see this to the end.

If ... IF ... you OLCers do indeed have to join in with RM - what are you doing to make sure you get what you should? What are you doing to make it so you can find something to bargain for - to ensure your side of things 'counts' in the long run? What bridges are you making sure not burn down? Like NOT publicly boycotting RM businesses? Or are you so black-n-white about the annexation you haven't even considered it?

The poster was only quoting Churchill and did make any reference to his political popularity. Churchill did indeed rally the Brits during those trying times, but he did it thoughout all of the British Isles, not just London as you claim. And, I hardly think of WWII as a "small event." Finally, I doubt all of this is about a clash of egos as you suggest. I am certain the Oak Level folks consider it an issue of freedom of choice.

Huh?

There isn't any negotiating here, either Oak Level is annexed or not. I don't see the city offering an olive branch here. If indeed they are annexed, the city will have to provide services to that community and they will have a vote the next time elections come up. It is a black and white, right and wrong issue. Would you compromise if your hard earned money was on the line? I think not.

Legal grounds

If the residents can't prove beyond a show of doubt that the states mandates for involuntary annexation has not been meet, the legal battle is a total lost of time and revenue. Because we may disagree with an issue in no way makes it illegal.

At this point

It is going to happen. Both parties are now wasting money. It's a good fight - it's a right fight - but it's a losing fight for EVERYONE.

The money now being wasted to fight this in courts - the time wasted isn't doing anyone any good. Time to make peace and come together and live together as a community not a bunch of bickering bitties.

Of course it won't end here - too many egos involved in Oak Level and too much invested by the City of RM. What a shame.

cheaper for Oak Level to fight

The amount of money contributed by me to fight this forced annexation is cheaper than the taxes I would have to pay. An appeal would save me another years worth of RMT city tax. Sadly this will mean that the tax paying citizens of the city will have to pay increase taxes to make up for any tax which isn't coming from Oak Level. The city budget is based in part on anticipated tax revenue which isn't coming. That why the city would like to move on with the annexation plans and put the legal fight behind.

Money

Rocky Mount is spending YOUR money. These people, who intentionally moved outside the city limits, are spending THEIR money. Rocky Mount doesn't have enough working people living inside the city limits to pay for all their needs, so they went looking. I say good for you, Oak Level. It's about time someone stood up to what is wrong with government, all government, today. Be it local, state, or federal, our governments need to know we have had enough.

For Future Good

Win or lose, OLCAFA's fight over forced annexation - along with many other communities fighting the same battle at this time - will help future legislation regarding NC annexation law. In other words, others will have a better tomorrow because of our struggle. NC Legislators are paying close attention to the how the communities, how the voters in those communities, are reacting to the current law on NC's forced annexation. We will change the legislature if they don't change the law.

Incorrect. That kind of thinking would mean Europe would still be fragmented and a hotbed for WWIII. WWII existed because Europe was vindictive. Germany's economy was in turmoil and along came a charismatic Hitler to save the day. Adolph Hitler would have never had the chance if it wasn't for the grudge of the Triple Entente. There is a big difference between this and war. For one, nobody will die. If you treat it like war, you will lose in more way than one. You should keep fighting. But get rid of the hate. It will only make your life worse.

I'm not going to get into this whole history lesson thing. My statement was more to the point of if you give up on a fight you believe in and what the end result would be. As for Germany's economy, Hitler was the one that ruined the economy, it was fine before Hitler.

I'm not equating anything here. In your opinion OLCAFA should give up to save you tax money, well that's not going to happen. If you're so worried about "can't we just get along" then call your city councilman and request they give up this fight. My point in my post was that if we gave up during WWII then we would have been taken over by Germany.
