Sanford man charged in Christmas Eve shooting death

SANFORD — Police in Sanford say a man is in custody after a fatal shooting on Christmas Eve.

The Fayetteville Observer reports police said 20-year-old Phillip Howard Fortune is charged with first-degree murder in the death of 46-year-old Michael Andre Smith.

A statement from police said officers were called to a home Tuesday, where they discovered Smith with a gunshot wound. Smith was taken to UNC Hospitals in Chapel Hill where he died early Wednesday. Fortune was arrested at his home on Christmas Day.

Fortune is being held without bail in the Lee County jail. It's not known if he has an attorney.
