Cooper still facing lawsuit amid potential run

RALEIGH — In late 2000, the Republican candidate for North Carolina attorney general and other lawyers in Dan Boyce's family sued Democratic rival Roy Cooper over a television ad they allege had defamed them.

Thirteen years later, Cooper is still the attorney general and is planning for a gubernatorial bid in 2016. And the same lawsuit remains in Wake County Superior Court.

There's been no final ruling on the case, which focuses on a TV commercial about legal fees sought in a 1990s class-action tax case against the state. A judge recently set a tentative trial date for late April.

Gene Boyce is Dan Boyce's father and says he remains eager to try the case. Cooper, an aide and his political committee defend the ad and says no defamation occurred.
