Asheville appealing ruling to reinstate officer

ASHEVILLE — Asheville is appealing a state Court of Appeals decision that it must reinstate a police officer fired after racist and pornographic images were found on a computer he rented.

The Asheville Citizen-Times reports officer Roger Aly rented the computer in 2009 and was fired in 2010. But in May, the appeals court ruled he should be reinstated.

Aly said the images were sent by others and apparently got on the computer when he backed up his Blackberry.

The state Supreme Court has stayed the Court of Appeals' decision but has not yet said whether it will hear the city's appeal.

City attorneys argue Aly's credibility is damaged and he could be the subject of complaints from the public by being viewed as tolerating racism and sexism.
